He did say that one's temperament can have an effect on whether one chooses to get in the car with a drunk driver.
"People who have a tendency to be anxious and cautious are less likely to take risks," Reams said. "And people who are more fearless and bold are more willing to take risks. And it's hard to convince a bold, fearless person to become less bold and more cautious."
Manslaughter charges
Dameron, who was indicted for manslaughter, will face two to 20 years in prison and/or a fine not to exceed $10,000.
Intoxication manslaughter is a felony, according to Associate Professor of Sociology Cynthia Gentry, who teaches criminology.
"To be indicted for manslaughter," Gentry said, "even though the student certainly did not intend to hurt anybody, the student engaged in reckless behavior that endangered other people. You can be charged for manslaughter when you do something that can put others in danger whether you meant to or not."
Gentry said that the severity of his punishment will be determined either by a trial or by a judge, should he plead guilty. The decision will take prior convictions and the circumstances of the manslaughter into account.
"The reason for the seriousness of intoxication manslaughter," Gentry said, "is that, on the one hand, we hope that seeing others being punished would make us think twice. The second reason would be that the person who is punished would not repeat the behavior."
